1. INTRODUCTION AND ACCEPTANCE

 

Welcome to Ohana Arts Foundation ("we," "us," "our," or "Ohana"). By accessing or using our website at https://www.ohanaartsfoundation.org, enrolling in our programs, or making a donation, you ("user," "you," or "your") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use our website or services.

Ohana Arts Foundation is a nonprofit arts education organization based in Marietta, Georgia. We provide professional performing arts training, mentorship, and scholarship support to students ages 6–18 across the metro Atlanta area. Our mission is to make high-quality arts education accessible to all students regardless of financial background.

 

Our services include:

  • Performing arts classes, workshops, and intensives

  • Scholarship and financial assistance programs

  • Community performances and events

  • Volunteer and mentorship programs

 

3. ELIGIBILITY

 

3.1 General Website Use

 

You must be at least 13 years of age to independently use our website or submit contact forms. If you are under 13, a parent or legal guardian must act on your behalf.

 

3.2 Program Enrollment

 

Our programs are open to students ages 6–18. Enrollment of students under 13 requires a parent or legal guardian to complete all registration forms, provide consent, and serve as the primary point of contact.

 

3.3 Donations

 

You must be at least 18 years of age and legally authorized to make financial transactions to donate through our website. By making a donation, you confirm that you are the authorized holder of the payment method used.

 

4. PROGRAM ENROLLMENT TERMS

 

4.1 Registration

 

Enrollment in Ohana Arts Foundation programs requires completion of a registration form with accurate and current information. You agree to:

  • Provide truthful, accurate, and complete registration information

  • Promptly update information if it changes

  • Notify us immediately of any medical conditions or special needs that may affect participation

 

4.2 Tuition, Fees, and Financial Assistance

Program fees, where applicable, will be disclosed prior to enrollment. Ohana Arts Foundation offers financial assistance and scholarship programs for qualifying students. To apply for financial assistance, contact us at Info@ohanaartsfoundation.org.

 

4.3 Attendance and Conduct

Students and families agree to:

  • Attend enrolled classes regularly and notify us in advance of absences

  • Treat all instructors, staff, volunteers, and fellow students with respect

  • Follow all rules and guidelines set by Ohana Arts Foundation instructors and staff

  • Refrain from disruptive, dangerous, or abusive behavior on program premises

 

We reserve the right to remove any student from a program without refund if their behavior creates a safety concern or disrupts the learning environment for others.

 

4.4 Refund Policy

 

Refund requests must be submitted in writing to Info@ohanaartsfoundation.org. Refunds are considered on a case-by-case basis at the discretion of Ohana Arts Foundation. Program fees paid toward scholarships or financial aid awards are non-refundable.

 

4.5 Photography and Media Consent

By enrolling in our programs, you acknowledge that Ohana Arts Foundation may photograph or video record students during classes, rehearsals, and performances for educational documentation and organizational promotional purposes. Separate written consent will be obtained before any photos or videos of students are published on our website or social media. You may opt out of photography/recording at any time by notifying us in writing.

 

5. DONATIONS

5.1 Tax-Exempt Status

 

Ohana Arts Foundation is a registered 501(c)(3) nonprofit organization. Donations made to Ohana Arts Foundation are tax-deductible to the extent permitted by law. A donation receipt will be emailed to you promptly after your contribution is processed. Please consult your tax advisor regarding the deductibility of your specific donation.

 

5.2 Donation Processing

All online donations are processed securely through Wix Payments or PayPal, both of which are PCI-DSS compliant. We do not store credit card information on our servers. By making a donation, you authorize Ohana Arts Foundation to charge your provided payment method for the donation amount specified.

 

5.3 Donor Intent

Donations made to Ohana Arts Foundation are used to support our general nonprofit mission and programs, including arts education, scholarships, and community outreach. If you wish to restrict your donation to a specific program or purpose, contact us at Info@ohanaartsfoundation.org prior to making your contribution.

 

5.4 No Refund on Donations

 

Donations to Ohana Arts Foundation are generally non-refundable. If you believe a donation was made in error or by unauthorized means, contact us at Info@ohanaartsfoundation.org within 7 days of the transaction. We will review each case individually.

 

5.5 Recurring Donations

 

If you set up recurring donations, you may cancel at any time by contacting us at Info@ohanaartsfoundation.org or 404-528-2191 at least 5 business days before your next scheduled contribution.

 

6. WEBSITE USE

 

6.1 Permitted Use

 

You may use our website for lawful, personal, and non-commercial purposes consistent with these Terms. You agree NOT to:

  • Use our website for any illegal purpose or in violation of any local, state, or federal laws

  • Attempt to gain unauthorized access to any part of our website or systems

  • Upload or transmit viruses, malware, or any other harmful code

  • Harvest, scrape, or collect personal information from our website

  • Use our website to send unsolicited communications (spam)

All content on our website including text, images, graphics, logos, videos, audio, and course materials is the property of Ohana Arts Foundation or its licensors and is protected by United States copyright and trademark laws.

  • Use our logo, name, or branding in any way that implies endorsement or affiliation

  • Create derivative works based on our content without written consent

 

7.2 Limited License to Users

7.3 Student Work

 

Original work created by students during Ohana Arts Foundation programs remains the intellectual property of the student (or their parent/guardian if under 18). By participating in our programs, students and families grant Ohana Arts Foundation a non-exclusive license to display student work for organizational promotional purposes with prior consent.

 

8. DISCLAIMERS AND LIMITATION OF LIABILITY

 

8.1 Website Disclaimer

 

Our website is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Ohana Arts Foundation does not warrant that:

  • The website will be uninterrupted, error-free, or completely secure

  • Information on the website is always accurate, complete, or current

8.2 Program Disclaimer

 

Participation in Ohana Arts Foundation programs involves physical activity including dance, movement, and performance. By enrolling, you acknowledge and accept these inherent risks. Ohana Arts Foundation takes reasonable precautions to ensure the safety of all participants.

 

8.3 Limitation of Liability

 

To the fullest extent permitted by Georgia law, Ohana Arts Foundation, its directors, officers, employees, and volunteers shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:

  • Use of or inability to use our website

  • Participation in our programs

  • Unauthorized access to or alteration of your data

  • Any errors or omissions in our content

Our total liability to any individual for any claim arising under these Terms shall not exceed the amount paid by that individual to Ohana Arts Foundation in the 12 months preceding the claim.

10. CHILDREN UNDER 13

 

Consistent with our Privacy Policy and COPPA, children under 13 may not independently use our website or create accounts. All website interactions on behalf of children under 13 must be conducted by a parent or legal guardian. Program enrollment for children under 13 requires full parental consent as described in our Privacy Policy.

 

11. TERMINATION

Ohana Arts Foundation reserves the right to:

  • Terminate or suspend your access to our website at any time for violation of these Terms

  • Remove any content you have submitted that violates these Terms

  • Cancel a program enrollment if a student's conduct creates safety concerns

Termination does not waive any rights or remedies available to Ohana Arts Foundation under applicable law.

 

12. GOVERNING LAW AND DISPUTE RESOLUTION

 

12.1 Governing Law

 

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

 

12.2 Jurisdiction

 

Any disputes arising from these Terms or your use of our website or programs shall be subject to the exclusive jurisdiction of the state and federal courts located in Cobb County, Georgia.

 

12.3 Dispute Resolution

 

Before filing any legal claim, you agree to first contact us at Info@ohanaartsfoundation.org to attempt to resolve the dispute informally. We will make good-faith efforts to resolve all disputes within 30 days of receiving written notice.

 

12.4 Class Action Waiver

 

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class action or collective proceeding.

 

13. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

 

14. ENTIRE AGREEMENT
